Welcome to The Athletic Professional (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our services, programs, content, and offerings (collectively, the “Services”), whether accessed through our website, third-party applications, or other platforms.

By accessing, purchasing, or participating in any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you should not use our Services.

SERVICE DESCRIPTION

The Athletic Professional provides high-performance training and coaching services, including:

  • Team Training Programs (remote or hybrid)

  • 1:1 Coaching and Individualized Programming

  • Performance Development Systems

  • Communication and Feedback via Third-Party Apps

Third-Party Platforms

All training programs, communication, and delivery of Services may occur through third-party applications (e.g., training apps, communication tools, or software platforms). By using our Services, you agree to comply with the terms and policies of those third-party providers.

We are not responsible for outages, errors, or data issues originating from third-party platforms.

PAYMENT TERMS

By purchasing any Service, you agree to the following payment structure:

Team Training

  • Payment options: Monthly or Annual

  • All payments must be made in advance of service delivery

  • Commitment applies for the selected billing cycle

1:1 Coaching & Individual Programming

  • Initial commitment: 6-month or 12-month term (paid in full in advance)

  • After initial term: transitions to monthly billing

  • Monthly payments must be made in advance of each billing period

Accepted Payment Methods

We accept payments through:

  • PayPal

  • Venmo

  • Squarespace Payments

  • Chase Payment Processing

You are responsible for ensuring your payment method remains valid and up to date.

Late or Failed Payments

We reserve the right to:

  • Suspend access to Services

  • Charge late fees or processing fees

  • Require updated payment information before continuing Services

Refund Policy

All payments are non-refundable unless otherwise stated in writing.

ACCOUNT & ACCESS

To access Services, you may be required to create an account on a third-party platform.

You agree to:

  • Provide accurate and current information

  • Maintain confidentiality of login credentials

  • Not share access to your account

We reserve the right to suspend or terminate access for violations of these Terms.

USER RESPONSIBILITIES

By participating in our Services, you agree to:

  • Follow all training instructions responsibly

  • Communicate honestly about injuries, limitations, and readiness

  • Use Services for lawful purposes only

  • Not distribute, copy, or resell training materials

ASSUMPTION OF RISK & DISCLAIMER

You understand that participation in athletic training involves inherent risks, including but not limited to:

  • Injury

  • Illness

  • Physical strain

  • In rare cases, serious injury or death

By participating, you:

  • Voluntarily assume all risks

  • Confirm you are physically able to participate

  • Agree to seek medical clearance if needed

The Athletic Professional is not a medical provider, and all guidance is for educational and performance purposes only.

NO GUARANTEE OF RESULTS

We do not guarantee specific performance outcomes. Results depend on many factors including effort, consistency, genetics, and external variables.

LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • Services are provided “as is” and “as available”

  • We are not liable for injuries, damages, or losses arising from participation

  • Total liability is limited to the amount paid for Services in the previous six (6) months

INTELLECTUAL PROPERTY

All programming, training systems, materials, and content are the exclusive property of The Athletic Professional.

You may not:

  • Reproduce

  • Distribute

  • Sell

  • Share

any materials without written consent.

TERMINATION

We reserve the right to suspend or terminate Services if:

  • Payment obligations are not met

  • Terms are violated

  • Behavior interferes with service delivery

You may cancel future Services, but no refunds will be issued for prepaid periods.

THIRD-PARTY SERVICES

We are not responsible for:

  • Performance of third-party apps

  • Data loss or outages

  • Terms or policies of those platforms

Use of those platforms is at your own risk.

GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the State in which The Athletic Professional operates, without regard to conflict of law principles.

CHANGES TO TERMS

We may update these Terms at any time. Continued participation in Services constitutes acceptance of updated Terms.
